Business and Commercial Litigation
Our attorneys regularly represent corporate clients in matters ranging from contract litigation, fiduciary, officer, director and shareholder litigation and unfair business practices to providing advice to employers and acting as a corporate attorney for the business or individual. Our clients include international corporations, national non-profit entities and regional and local businesses. On behalf of our clients, we conduct litigation, arbitration or mediations where appropriate. Ney Hoffecker & Erck also represents corporations which contract with governmental entities to provide services to the public of the government itself. Ney Hoffecker & Erck works with its clients during the Request for Proposal (RFP) process, negotiating contracts and litigation, if necessary.

Our attorneys assist corporate clients in numerous industries, including manufacturing, professional services, waste handling and land filling, technology, distribution, retail, and financial services. We provide legal advice in areas such as contract negotiation, dispute resolution, financial transactions, leasing, mergers and acquisitions, employment and severance agreements, and intellectual property services on behalf of our clients. In addition, our business attorneys will attend meetings of board of directors and managers upon request.
Complex Litigation/Liability Litigation
Ney Hoffecker & Erck represents corporate and individual clients in matters involving premises liability, products liability, negligence and professional malpractice either through insurance coverage or where there is no insurance coverage. Our attorneys have a large Liability litigation practice representing property owners (commercial and private), professionals (directors, officers, licensed professionals (non-medical)), elevator and escalator maintenance companies and governmental entities. Ney Hoffecker & Erck attorneys regularly appear in trial courts, arbitrations and mediations throughout Georgia defending the interests of our clients.

Corporate and Business Organization
Our firm’s business services offered include legal and tax advice regarding the most desired business form, forming the entity, and preparing all necessary documents, including operating agreements, partnership agreements, shareholders’ agreements and bylaws. In addition, we assist our clients with their business succession and dissolution needs, as well as advising them upon the withdrawal of an owner.
Employment Litigation
Ney Hoffecker & Erck maintains a robust practice representing the interests of primarily employers in federal and state litigation under Title VII, §1981, the ADA, the Pregnancy Discrimination Act, the ADEA and other state and federal labor laws. We routinely represent employers throughout the pre-suit process with the EEOC and through litigation and trial. Additionally, Ney Hoffecker & Erck represents employers directly and through their insurance (EPLI) coverage in litigation throughout Georgia involving claims of discriminatory or unlawful employment practices. Ney Hoffecker & Erck also is litigation panel counsel for large national Professional Employment Organizations (PEO’s), which provide human resource and payroll services to employers.

Ney Hoffecker & Erck provides extensive estate planning and asset protection planning services to its clients, as well as assistance with their probate and probate litigation needs.
High Net Worth and Contested Divorce/Family Law
Ney Hoffecker & Erck represents individuals in contested and high net worth divorce matters. Our attorneys are experienced family law litigators and have successfully protected the rights of firm clients in divorce and related proceedings. Our attorneys provide business valuations for family owned businesses; division of family residences (including vacation homes, investment properties and retirement homes); division of investment accounts and stock portfolios; division of debts and tax obligations; and locate and attach hidden assets.
